South Korean Ministry of Justice announced the “Special Foreigner Advancement International System” will be implemented from September 11 to December 31, 2023.
The “Illegal Residence” policy exempts fines and suspends entry restrictions for illegal aliens who leave the country in a relevant period on their own until December 31.
This policy is being implemented on a temporary basis in order to give incentives to illegal foreigners who wish to voluntarily leave the country in parallel with the joint governmental crackdown, while it is in operation and is an opportunity for the illegal foreigners to leave the country on their own.
Those who voluntarily leave the country must follow the current ‘Voluntary Departure Prior Reporting System’ with advance notification at least 3 days prior to departure date and have to submit passport, voluntary departure report, departure airline ticket when self-reporting in the immigration.
However, the “Special Foreigner Advancement International System” exclude the illegal immigrants, those using forged passports, criminals, and those who fail to comply with departure orders.
The Ministry of justice will show no relaxation and is planning to take strict action, includes imposing additional restrictions and strengthening entry bans.
The Ministry of justice said, the illegal aliens are the subject to crackdown if they do not leave the country during this voluntary departure period. If caught by the immigration, not only will be deported, but will also be subject to a fine of up to 30 million won.
Han Dong-hoon, the Minister of Justice said, “The basic premise of a flexible immigration policy for foreigners is the establishment of order of stay, including crackdown on illegal stay. In the future, joint government crack downs, etc.”
“While we will consistently crack down on illegal stays, we will do our best to establish a strict stay order by actively encouraging illegal stayers to voluntarily leave the country.” he added.
